Perez et al v. Owl, Inc.
Filed: June 15, 2017 ◆§ 6:17-cv-01092-CEM-GJK
Owl, Inc. (which does business as Owl Inc. Transportation) is the defendant in a lawsuit that alleges it failed to pay its employees proper wages.
Owl, Inc. (which does business as Owl Inc. Transportation) is the defendant in a proposed class and collective action that alleges it failed to pay its employees proper wages. The plaintiffs say they work as “road supervisors” providing transportation to clinics and hospitals for veterans or other patients who are unable to drive on their own. They often work more than 40 hours per week without receiving overtime compensation for their extra hours, according to the suit. The complaint claims, however, that “[t]hey are not bona fide executive, administrative, or professional employees; they do not meet the minimum salary threshold to qualify as exempt employees; nor do they fall under another exemption from overtime pay.”
The suit further argues that the drivers are not paid according to the prevailing wage rate for ambulance drivers, though their jobs fall under this title according to the Service Contract Act Directory of Occupations. On May 11, 2017, the prevailing wage rate that would apply to the drivers was raised to $17.78 per hour, yet they receive “much lower” wages, according to the suit.
