Homestyle Desserts is facing a class action out of New York claiming it owes unpaid overtime and minimum wages under the Fair Labor Standards Act (FLSA). Filed by a former dishwasher, machine cleaner and cookie maker, the 20-page suit contends the pastry purveyors failed to compensate the plaintiff and other current and former employees for all hours worked over 40 in a week, as well as state-mandated spread-of-hours pay. Furthermore, the plaintiff alleges she received all of her wages in cash and was never given legally required wage and hours records.
