A proposed collective action has been filed against Ourisman Chantilly Imports Inc., which does business as Ourisman Fairfax Toyota, alleging violations of the Fair Labor Standards Act. The plaintiff claims he and other similarly situated employees were hired by the defendant to wash, clean and details cars at the Ourisman Toyota of Fairfax, Virginia. The named plaintiffs claim that they worked 80 hours per week over a nearly two-year period between February 2014 and May 2016 without proper overtime pay. According to the suit, between the two workers, the total amount of unpaid overtime wages is more than $80,000. The case looks to cover an opt-in class of non-exempt car wash and detailing employees who worked overtime for the defendant but did not receive proper time-and-a-half wages.
