Soriano Reyes et al v. Ottomanelli's Cafe Franchising Corp. et al
Filed: February 10, 2017 ◆§ 1:17-cv-01035
Ottomanelli's Café is facing a proposed collective action filed over alleged Fair Labor Standards Act (FLSA) violations.
Ottomanelli’s Café Franchising Corp, which operates as Ottomanelli’s’ Café, Ottomanelli Brothers Ltd., which operates as Ottomanelli Bros., and the companies’ owners are facing a proposed collective action filed over alleged Fair Labor Standards Act (FLSA) violations. The plaintiffs claim they were ostensibly hired by the defendants as delivery workers, yet spent a “considerable” part of their work days performing non-tipped duties. The case claims that, due to the defendants allegedly taking a tip credit to which they weren’t entitled, the plaintiffs and similarly situated workers were not paid mandatory minimum wages, spread-of-hours pay (owed for shifts that last longer than 10 hours in a day), and time-and-a-half hourly overtime wages for all hours worked over 40 in a week.
