A proposed class action has been filed against O'Connell Protection Services, LLC and its owner that claims security guards were not proper overtime wages.
A proposed class action has been filed in New York against O’Connell Protection Services, LLC and its owner that claims individuals working as security guards were not paid proper time-and-a-half overtime wages. The suit’s named plaintiff, who worked for the defendants from 2013 through December 2016, claims he worked between 43 and 77 hours per week without being paid at the mandatory time-and-a-half hourly rate for all hours worked past 40. The case claims that the plaintiff and similarly situated workers were paid at their straight hourly rate for hours worked over 40 that called for time-and-a-half pay.
