The operating company of Wise Espresso Bar and two individuals are facing allegations that they failed to pay their employees proper wages. Two servers who worked in the New York City espresso bar filed suit against their former employer, claiming they were not offered any compensation other than customer tips for the duration of their employment. The suit alleges that the defendants violated several provisions of the Fair Labor Standards Act and New York Labor Law, including failure to pay time-and-a-half overtime wages, failure to pay minimum and spread-of-hours wages, failure to provide wage statements and keep accurate records, and unlawful tip deductions. According to the suit, the defendants retained over 8% of the plaintiffs’ tips to cover the cost of credit card processing fees and required them to surrender $100 of tip money to their manager for each day they worked.
