April Corp., which does business as Terra Market on 9th Avenue in New York City, is the defendant in a proposed collective action seeking to recover allegedly unpaid minimum and overtime wages. The plaintiff, employed as a cleaner and stock person by the defendant from January 2016 through March 2017, claims he worked between 11 or 12 hours per day, six days per week, without being paid proper minimum or time-and-a-half hourly overtime wages. Moreover, the plaintiff says he and proposed collective members were never given proper spread-of-hours wages (owed under New York state law) or wage statements documenting rates of pay or hours worked.
