A former server has filed a proposed class action in New York against Manhattan Food & Beverage, LTD., which does business as Reichenbach Hall, and its owners.
A former server has filed a proposed class action in New York against Manhattan Food & Beverage, LTD., which does business as Reichenbach Hall, and its owners claiming employees were not paid proper wages under state and federal labor laws. The plaintiff alleges the defendants illegally utilized a tip credit on servers’ wages to which they were not entitled, causing the workers’ pay to drop below the state and federal minimum.
The case notes a 2016 investigation in which it was found that one of the plaintiff’s managers was stealing money that included workers’ tips from the restaurant. This money, the suit continues, was never returned to the service team.
Lastly, the plaintiff says the defendants required proposed class members to pay for their own uniforms (without reimbursement) and pay out of their own pockets in the event customers left the restaurant without paying their bills.
