The owning and operating entity of Central Dental and Yorkvill Dental is the defendant in a class action out of New York that claims UES Dental, PLLC did not pay employees proper overtime wages under the Fair Labor Standards Act (FLSA). According to the case filing, the plaintiff split her time between Central Dental and Yorkvill Dental, with her wage calculation being intentionally “skewed” by the defendants so she would not be paid time-and-a-half overtime wages. The complaint claims “on any given week, if [the plaintiff] worked overtime, her overtime hours for that week will be allocated to the later weeks that she worked less than 40 hours so those hours would not be properly compensated at the premium overtime rate.” Further, the plaintiff claims she was never paid for her last 16 days of work.
