Bukhara Indian Cuisine, Inc. and Basera Indian Cuisine, Inc., which operate Indigo Indian Bistro and Basera Restaurant, respectively, have been hit with a class action.
Bukhara Indian Cuisine, Inc. and Basera Indian Cuisine, Inc., which operate Indigo Indian Bistro and Basera Restaurant, respectively, and two individuals are the defendants in a proposed collective action seeking allegedly unpaid minimum wages. Citing alleged Fair Labor Standards Act (FLSA) violations, the case claims that in addition to failing to pay mandatory minimum wages, the defendants allowed non-tipped employees to share in tipped employees’ rightful tips.
The plaintiff alleges he usually worked from 11:00 a.m. to 11 p.m. five or six days a week between the defendants’ locations and was never properly paid.
“[The defendants] did not pay [the plaintiff] an hourly wage at all. [The defendants] did not distribute to [the plaintiff] the tips he earned as a server,” the case alleges. “Instead [the defendants] paid [the plaintiff] random sums of money, ranging from $200 to $600 per week, without any extra compensation.”
