The owning and operating entities of two San Loco Tex-Mex restaurants in New York City are the defendants in a proposed class action over allegedly unpaid overtime wages.
The owning and operating entities of two San Loco Tex-Mex restaurants in New York City are the defendants in a proposed class action over allegedly unpaid minimum, overtime and spread-of-hours wages. According to the plaintiff, who worked as a cook and porter for the defendants until January 2017, she and proposed class members were never appropriately paid for any hours worked over 40 in a workweek or spread-of-hours pay owed for shifts lasting longer than 10 hours in a day.
The plaintiff claims that in addition to working more than 52 hours a week without overtime pay or mandatory break periods, the defendants also unlawfully withheld 60 percent of the tips she earned from customers without providing prior notice.
