A proposed class action filed in Tennessee district court claims the below defendants, as well as individually named owners, board members and corporate officers, violated the Fair Labor Standards Act (FLSA) by failing to pay proper overtime wages:
- Cumberland Pediatric Dentistry and Orthodontics, PLLC
- Cumberland Pediatric Dentistry and Orthodontics of Cookeville, PLLC
- Cumberland Pediatric Dentistry of Lawrenceburg, PLLC
- Cumberland Pediatric Dentistry and Orthodontics of Murfreesboro, PLLC
The case alleges the defendants failed to pay proper time-and-a-half hourly overtime wages, which are owed for all hours worked over 40 in a workweek, to individuals employed as office workers, dental assistants, and dental hygienists. The defendants allegedly intentionally misclassified proposed class members as exempt from overtime to circumvent their obligation to pay time-and-a-half overtime wages. According to the plaintiff, the defendants would only pay overtime wages if an employee worked in excess of 80 hours over a two-week period, rather than if the individual worked more than 40 hours in a one-week period.
