Nova Mud, Inc. and its president are facing a proposed class action that says the oilfield drilling fluid products company failed to pay overtime wages to drilling fluid engineers. The lawsuit, filed in New Mexico district court, claims the plaintiff and proposed class members were unlawfully paid on a salary-only basis due to their misclassification as exempt employees.
The plaintiff claims that he and proposed class members regularly worked more than 80 hours per week—and were required to do so by the defendants—without being paid time-and-a-half.
