A former Petco assistant manager has filed a proposed class action claiming the company failed to pay certain workers proper overtime wages under New Jersey law.
A former Petco assistant manager has filed a proposed class action claiming the company—specifically Petco Animal Supplies, Inc. and Petco Holdings, Inc.—failed to pay her and similarly situated workers for all hours worked, including overtime, under New Jersey state labor law. The plaintiff, who worked for the defendants from March 2013 through October 2015, claims she regularly worked more than 40 hours per week without being paid time-and-a-half wages for each hour worked over 40. Although the plaintiff and some similarly situated employees had assistant manager job titles, the complaint alleges the workers did not fit the managerial requirements to be considered exempt from overtime pay under New Jersey Wage and Hour Law.
