A New Jersey freight company, leasing company and executive have been hit with a lawsuit for unpaid minimum wages. According to the suit, Colonial Freight Systems Inc. and others violated federal law by misclassifying the named plaintiff and other workers as independent contractors.
The suit claims the defendants deducted from and withheld portions of proposed class members wages, failed to pay for time spent in driver training programs, and required proposed class members to cover certain business costs. The plaintiff is asking for the court to certify a class of truck drivers (or those in similar positions) who were classified as independent contracts by the defendants and worked within the applicable statute of limitations.
