A proposed class action lawsuit claims electrical contractors NJ NEC, Inc. and the company’s owner committed “massive fraud” against New Jersey’s taxpayers by failing to pay its workers proper wages, including for state-contracted public works jobs. The 19-page lawsuit cites alleged violations of the Fair Labor Standards Act (FLSA) and the New Jersey State Wage and Hour Act.
“The defendants engaged in services relating to electrical contracting work in New Jersey. Jobs performed by [the defendants] involved public jobs where prevailing wages were to be paid,” the complaint claims. “By failing to pay prevailing wages to [the plaintiff] and the similarly situated, the defendants committed a massive fraud against New Jersey State, its taxpayers and departments.”
The plaintiff, who worked as an electrician for the defendants until August 2016, claims he was never paid proper time-and-a-half overtime wages at any time throughout his employment. The man claims he and similarly situated employees (of which there may be as many as 50) worked a minimum of 45 hours per week – and sometimes up to 70 hours per week.
