Legend 72, LLC, which does business as Legend 72 Upper Westside, and three of its managers are the defendants in a proposed class action lawsuit.
Legend 72, LLC, which does business as Legend 72 Upper Westside, and three of its managers are the defendants in a proposed class action lawsuit regarding alleged violations of the Fair Labor Standards Act (FLSA) and New York Labor Law (NYLL). The plaintiff, on behalf of himself and other similarly situated employees, alleges the restaurant failed to pay him the required minimum wage, overtime wages, and the “spread of hours” wages entitled to him by law. He claims he worked an average of 60 hours per week without overtime pay and was denied the required break time and extra pay he was due for working 10- to 12- hour shifts. According to the complaint, Legend 72 neglected to keep an accurate record of employees’ hours and wages “in order to mitigate liability for their wage violations” and did not provide their employees with accurate and complete pay stubs. The suit seeks injunctive and monetary relief for anyone who was a non-exempt employee of Legend 72, including dishwashers, delivery drivers and cooks, during the past three years and who did not receive proper wages.
