A lawsuit has been filed against the operating companies of five New York restaurants and two individuals for allegedly failing to pay their employees proper wages.
A proposed class and collective action lawsuit has been filed against the operating companies of five New York restaurants and two individuals for allegedly failing to pay their employees the required wages under federal and state law. The companies own three restaurants known as Riko Peruvian Cuisine, one known as Riko Peruvian Cuisine Express, and one known as Cumbia and Sabor, and they implement the same unlawful policies and practices at each one, according to the complaint. The plaintiff claims she was often required to work more than 40 hours per week without receiving time-and-a-half overtime compensation. She further insists that she was paid below minimum wage and forced to share her tips with a manager, in violation of the Fair Labor Standards Act and the New York Labor Law.
