The controlling company of New York City's Pizza & Pita restaurant and two individuals with operational control of the eatery are facing a proposed class action.
The controlling company of New York City’s Pizza & Pita restaurant, Pizza & Pita 34th, Inc., and two individuals with operational control of the eatery are the defendants in a proposed collective action over alleged wage and hour abuses of the Fair Labor Standards Act (FLSA).
According to the complaint, the plaintiff worked for the defendants making pizza, serving customers and packaging deliveries from October 2016 until February 2017. The man worked an average of 54 hours per week, yet was allegedly not paid time-and-a-half overtime wages for all hours worked past 40. Throughout the plaintiff’s employment, the case continues, no system existed with which he could track the times he clocked in and out of work. Further, the defendants allegedly failed to provide the plaintiff and proposed collective members with adequate meal breaks throughout each work day.
