New Jersey Class Action Seeks Unpaid Prevailing Wages for Superstorm Sandy Repair Project

Four plaintiffs have filed a proposed class action in New Jersey against the below defendant companies (and five individuals) over allegations that the parties failed to properly pay prevailing wages for public works repair projects performed in the aftermath of Superstorm Sandy:
- CrowderGulf, LLC;
- Bil-Jim Construction Company, Inc.;
- Maple Lake, Inc.;
- R. Kremer and Sons Marine Contractors, LLC;
- ABC Corporations (1-100);
- DEF Corporations (1-500);
The subject of the lawsuit, dubbed the Sandy Project, served the purpose of repairing Barnegat Bay by removing large debris and dredging the body of water to its pre-storm depths, thereby making it safely navigable once again. Material dredged from the bay would then be used to rebuild beaches damaged by the catastrophic storm, the lawsuit reads.
The plaintiffs—who worked on the Sandy Project at various times between late 2012 and the end of 2013 as tug boat and machine operators and engineers, among other roles—claim the contractor defendants violated the New Jersey State Prevailing Wage Act by failing to pay proper base rates, shift differentials, overtime, and double time owed for work performed on Sundays and holidays.
The proposed class covered by the lawsuit includes (from the complaint):
“All employees of Crowder Gulf, together with those of its subcontractors and their sub-subcontractors, on the Sandy Project (described herein) involving waterway debris removal, sand dredging, beach rebuilding, and bay repairing, in the ‘Central Region of New Jersey’—who performed work in crafts or trades subject to, but were not paid in accordance with, the PWA and/or the PW Rate Sheets issued in connection with same.”
