Third-party package service NEA Delivery, LLC is the defendant in a proposed class action filed on behalf of delivery drivers who are allegedly owed unpaid overtime wages for work dating back to January 20, 2014. The lawsuit, which cites violations of the Fair Labor Standards Act (FLSA), alleges proposed class members were permitted by the defendant to work more than 40 hours each week without being paid at the time-and-a-half hourly overtime rate for each hour worked past 40. Specifically, the plaintiff claims the defendant employed an off-the-clock work policy for which proposed class members were allegedly not paid for time spent performing pre-shift and post-shift work at third-party shipping centers.
