The owning and operating entity of Napoli’s Pastaria in Florida is facing a proposed class action filed by former kitchen workers who say they were not paid time-and-a-half overtime wages when working more than 40 hours in a workweek. The complaint alleges the defendants, the restaurant’s owners, created two sets of hourly employee time records as a way to avoid paying overtime to proposed class members. “While the first set of records show actual time workers by [the plaintiffs],” the lawsuit claims, “the second set misrepresents that [the plaintiffs] only worked 40 hours per week.”
More egregiously, the plaintiffs say the defendants in 2015, after being hit with an unpaid overtime lawsuit, worked with a computer engineers to “crash” the restaurant’s computer systems in an attempt to destroy sales, payroll and hours worked information. The defendants say this course of action was taken to both avoid IRS tax liability and overtime obligations.
