A man who worked as a handyman at Millennium Care has filed a proposed class action claiming the Bronx-based homeless shelter and its owner owe him unpaid overtime.
A New York man who worked as a handyman at Millennium Care has filed a proposed class action claiming the Bronx-based homeless shelter and its owner owe him unpaid overtime wages under the Fair Labor Standards Act (FLSA). The 21-page lawsuit claims the plaintiff worked long days doing repair work for the homeless shelter and was never paid time-and-a-half overtime wages or spread-of-hours pay for shifts that lasted longer than 10 hours in a day.
According to the complaint, the plaintiff typically worked between 63.5 and 73.5 hours a week, sometimes starting his work days as many as three hours prior to his scheduled start time, without receiving overtime wages. Additionally, the plaintiff says he never received any wage and hour statements from the defendant.
