A proposed class and collective action has been filed against Los Galanes, Blue Margarita and Angelina’s Mexican Restaurant, among others, alleging the defendants willfully violated the Fair Labor Standards Act in regard to overtime pay. The suit claims that the restaurants’ non-salaried managers, cashiers, bartenders, bussers, servers and kitchen staff weren’t paid time-and-a-half wages when working more than 40 hours per week. Furthermore, according to the suit, the defendants failed to provide the plaintiff and proposed class members with accurate W-2s listing all wages earned. The suit is seeking back pay and other damages and is hoping to certify a class of those who worked for the companies within the past three years and who were illegally denied overtime pay.
