A proposed collective action citing potential violations of the Fair Labor Standards Act (FLSA) and the Arkansas Minimum Wage Act (AMWA) claims defendant Metro Tech Service Corp. failed to pay current and former HVAC workers proper wages. The lawsuit alleges the defendant, which handles installation, repair and maintenance of retail store HVAC units, required employees to work off the clock as a means of avoiding paying proper wages for all hours worked.
“Specifically, [the plaintiff] was only compensated for time worked beginning one hour after he left his home for the day and ending one hour before he arrived back at his home at the end of the workday,” the case alleges.
