A former sales associate has filed a class action against Arizona's Mega Furniture and others claiming he was unlawfully paid on commission only.
A former sales associate has filed a class action against Arizona’s Mega Furniture and others claiming he was unlawfully paid on commission only and is owed substantial unpaid minimum and overtime wages. In addition to the stores’ owners and operators, the lawsuit names the following defendants:
- Gilbert Mega Furniture, LLC
- Ahwatukee Mega Furniture, LLC
- Mega Furniture & Accessories, LLC
- Mega Furniture Avondale, LLC
- Mega Furniture Scottsdale, LLC
- Phoenix Mega Furniture, LLC
The plaintiff says he typically worked 45 hours per week and was paid only the commission he received for sales with no set minimum wage or overtime pay. During one two-week pay period, the plaintiff mentions, he worked 90 hours and earned only $518.38, which translates to an hourly rate that is far below the federal minimum wage. Further, the plaintiff says proposed class members were disciplined if they did not work at least 90 hours over a two-week pay period and were not compensated for attending weekly sales meetings that frequently lasted as long as two hours.
