MModal Services, Ltd., Inc. is the defendant in a proposed class action lawsuit filed by two former employees who claim they were denied minimum and overtime wages during their employment as medical transcriptionists. The plaintiffs allege they were responsible for transcribing and editing medical documents and were paid per line for what was known as “hands on the keyboard time.” They say they were uncompensated for all the other duties performed in order to ensure their documents were accurate, including corresponding via email, verifying data, searching for missing information, and communicating with technical support regarding software issues. They were often forced to log in to their computers, search for jobs, and log out if they could not find work to do, all of which was uncompensated time, according to the complaint. As a result, the suit claims that the plaintiffs’ pay fell below the required minimum wage and overtime rate, in violation of the Fair Labor Standards Act.
