A proposed collective action out of Florida claims Mattress One, Inc., SOS Furniture Company, Inc., and four individual defendants are responsible for wage and hour violations of the Fair Labor Standards Act (FLSA) and Florida Minimum Wage Act. The two former store managers who filed the lawsuit allege they and similarly situated employees were not paid proper minimum or time-and-a-half overtime wages.
The crux of the lawsuit, the plaintiff alleges, is the defendants’ requirement of proposed collective members to arrive at the store prior to opening and to stay after store hours. The case claims proposed collective workers were not compensated for this time spent working, and that the defendants regularly reduced the number of hours for which employees would be paid.
