A proposed class action bumped from Southern to Central California district court claims that department store operator Marshalls of CA, LLC maintains an unlawful policy of not paying supervisors and managers for daily closing duties.
According to the lawsuit, the company requires supervisors and managers to clock out before activating the alarm, clearing the store, and locking up, among other closing tasks. The plaintiff, an assistant merchandising manager at the defendant’s San Marcos store, claims she spends between five and 10 minutes closing up each workday without compensation. This alleged off-the-clock work results in unpaid minimum and overtime wages, as well as inaccurate paystubs, the suit charges.
