A proposed class action out of New Jersey alleges defendant LYCA TEL, LLC violated the Fair Labor Standards Act (FLSA) by failing to pay proper wages. The plaintiff, who worked for the SIM card-selling company from November 2015 through December 2016, claims he was never paid agreed-upon commissions. To this point, the plaintiff says he and similarly situated employees often worked more than 40 hours per week without time-and-a-half overtime pay.
The complaint further alleges the plaintiff was terminated in December 2016 after complaining about the lack of overtime pay and commission payments.
