A proposed class action citing alleged violations of the Fair Labor Standards Act (FLSA) and New York state labor laws has been filed against Luoyang Uncle, Inc. (which does business as the Uncle Luoyang restaurant in New York City) and Wen Wu Chen, as well as individual defendants. The lawsuit, filed by a former kitchen worker, claims the restaurant and its operators engaged in a practice of failing to pay its workers proper minimum, overtime and spread-of-hours wages.
The plaintiff claims he worked 11 hours per day for a total of approximately 66 hours per week without receiving proper wages.
