A former warehouse keeper has filed a proposed wage and hour class action against H.C. International Inc. and its operators.
A former warehouse keeper has filed a proposed wage and hour class action against H.C. International Inc. and its operators claiming he and similarly situated employees are owed unpaid overtime wages. The plaintiff claims he regularly worked at least 44.5 hours a week without an uninterrupted lunch break and was not paid the time-and-a-half hourly rate for all hours worked over 40.
The lawsuit notes that the plaintiff, at 63 years old, was the oldest employee at H.C. International. After undergoing a surgical procedure that called for two weeks of recovery time, the plaintiff says he was unceremoniously terminated after being told that “he was too old” and that his former employer “could not afford to employ a ‘disabled person’ who would regularly require medical leave.”
