Donato v. Service Experts, LLC et al
Filed: April 19, 2017 ◆§ 1:17-cv-00436-DNH-CFH
Service Experts, LLC (which does business as Service Experts Heating and Air Conditioning), a subsidiary, and an individual owner are the defendants in a lawsuit.
Service Experts, LLC (which does business as Service Experts Heating and Air Conditioning), a subsidiary, and an individual owner are the defendants in a proposed class action lawsuit filed by a former employee. The plaintiff claims he worked for Service Experts as a plumber and was required to be “on call” for one week every month without being paid for all the hours he spent on call. During those hours, he says he was required to remain in his home in case a customer called for immediate service. The suit argues that on call employees were only paid for the hours they spent responding to a customer’s request, but not the time they spent waiting at home for the calls to come in. The plaintiff claims he is owed the overtime and minimum wages that Service Experts failed to pay him during the weeks he was on call.
