McVac Environmental Services, Inc. is facing a man’s proposed class action lawsuit that accuses the company of failing to pay prevailing wage rates and supplemental benefits to workers employed on various utility projects across New Jersey and New York. According to the complaint, the defendant contracted with Con Edison, National Grid, and PSEG Long Island to perform various clean-up, waste removal, restoration, and remediation services on several of the parties’ projects. Under the terms of the contracts, the defendant was allegedly required to pay its workers at the prevailing wage and supplemental benefit rates, which the suit says ranged from $50 to $80 per hour, depending on the type of work performed, the location, and the year. Instead, McVac paid the plaintiff $16 per hour, the complaint argues, and denied him overtime wages despite requiring him to work between 10 and 12 hours per day.
