First Choice Communications LLC is facing a proposed class action in which a California man claims the television service provider baited prospective customers to sign up for DirecTV with false promises of Visa gift cards and free NFL programming.
First Choice Communications LLC is on the receiving end of a proposed class action in which a California man claims the television service provider baited prospective customers to sign up for DirecTV with false promises of Visa gift cards and free NFL programming.
According to the lawsuit, the defendant represented to the plaintiff that he would receive three Visa gift cards totaling $400 and two years’ worth of NFL Sunday Ticket programming for free if he switched to DirecTV. The man alleges, however, that he received instead only one $100 gift card and no free NFL programming.
The lawsuit points out that incentives such as those allegedly promised by First Choice are “a key factor” in consumers’ purchasing decisions when considering switching TV service providers. The company’s supposedly false representations were therefore unlawful, the case says, and caused consumers to pay for services in exchange for benefits they never received. From the complaint:
“Defendant’s misrepresentations and/or omissions to Plaintiff and others similarly situated caused them purchase [sic] the Class Product, which Plaintiff and others similarly situated would not have purchased absent these misrepresentations and/or omissions by Defendant and its employees. In so doing, Defendant has violated California consumer protection statutes.”
