A former employee claims in a proposed class action lawsuit that defendants State Insurance U.S.A., LLC and its owner failed to pay proper overtime wages under the Fair Labor Standards Act (FLSA). The plaintiff claims the defendants communicated that commissions would be paid to those employed as agents to cover hours worked over 40, yet commissions allegedly went unpaid. In addition to non-payment of time-and-a-half overtime wages, the defendants allegedly also failed to provide proposed class members with proper meal break periods and failed to record time and compensable hours for each workday.
