A certified nurse's assistant has filed a proposed class action that alleges defendant Family Private Care, Inc. unlawfully misclassified certain employees.
A certified nurse’s assistant has filed a proposed class action that alleges defendant Family Private Care, Inc. unlawfully misclassified certain employees as independent contractors in violation of the Fair Labor Standards Act (FLSA). This misclassification, the lawsuit claims, resulted in proposed class members not being paid proper time-and-a-half hourly overtime wages.
The proposed class covered by the cased includes all non-exempt certified nurse’s assistants, licensed practical nurses and home health care aides who worked for the defendants at any time in Florida since January 1, 2015.
