Lakeland Chophouse, LLC, which does business as Manny's Original Chophouse, and its owner are staring down a proposed class action lawsuit.
Lakeland Chophouse, LLC, which does business as Manny’s Original Chophouse, and its owner are staring down a proposed class action lawsuit filed over allegedly unpaid minimum and overtime wages. Filed by two former employees, the lawsuit claims the defendants unlawfully took a tip credit on servers’ wages to which they were not entitled. Additionally, the plaintiffs say the defendants forced them to pool their tips with workers who do not customarily receive tips, such as kitchen expeditors who generally do not interact with customers.
On top of the above allegations, the plaintiffs claim they and proposed class members often worked in excess of 40 hours a week without being paid at the time-and-a-half hourly overtime rate called for by the Fair Labor Standards Act (FLSA).
