Medfirst Consulting Healthcare Staffing, LLC is the defendant in a lawsuit filed in Oregon after it allegedly misclassified employees as independent contractors and denied them overtime wages in violation of the Fair Labor Standards Act. The plaintiffs claim they worked for Medfirst as consultants, providing information technology services to the healthcare industry, and would regularly work every day for 12 hours a day. They were allegedly paid at a flat hourly rate, even for the hours they worked past 40 in a workweek. The plaintiffs further claim that Medfirst retained control over many aspects of their work, including pricing, shift schedules, and time off. According to the complaint, “Plaintiffs and FLSA Class Members have little or no authority to refuse or negotiate MedFirst’s rules and policies,” indicating they cannot be classified as independent contractors. The proposed class includes people who were classified as independent contractors while working for Medfirst in the United States from March 23, 2014 to present.
