Cruz v. Humana at Home 1, Inc. et al
Filed: April 11, 2017 ◆§ 0:17-cv-60716-WPD
A proposed wage and hour class action claims Humana At Home 1 and Humana, Inc. failed to pay certain employees proper time-and-a-half overtime wages.
A lawsuit has been filed on behalf of individuals currently or formerly employed as “personal health coaches,” “healthcare coordinators,” and in other similarly named positions against Humana At Home 1, Inc. and Humana, Inc. over allegedly unpaid overtime wages. The lawsuit, filed in Florida, alleges proposed class members—responsible for providing a variety of case management and care services for Medicare enrollees—are entitled to overtime pay due to the non-exempt nature of their work and were subject to a “’scheme” to deprive them of rightful wages.
The complaint asserts the defendants required proposed class members to work long hours and on weekends to complete all their job responsibilities and to “meet productivity standards.”
