From Ohio federal court comes a proposed collective action that claims home health aides working for defendant Northeast Home Health Services LLC were not paid proper time-and-a-half hourly overtime wages. Citing alleged abuses of the Fair Labor Standards Act (FLSA) and Ohio Minimum Fair Wage Standards Act (OMFWSA), the plaintiff claims the defendant ignored the October 2013 U.S. Department of Labor ruling granting minimum and overtime wage protections to millions of the nation’s home healthcare workers.
In addition to the alleged non-payment of overtime, the defendant reportedly failed to pay the plaintiff and similarly situated workers for hours spent performing work between client appointments, particularly for time spent traveling to and from clients’ homes.
