A woman working as a home health aide in Pennsylvania has filed a proposed class action against Veritas Consultant Group, which does business as Moravia Health Network.
A woman working as a home health aide in Pennsylvania has filed a proposed class action against Veritas Consultant Group, which does business as Moravia Health Network, for its alleged failure to pay overtime wages. According to the complaint, the plaintiff regularly worked in excess of 40 hours per week, as recorded in her timesheets, but was never given time-and-a-half overtime pay.
Effective January 1, 2015, the Department of Labor instituted the Home Care Final Rule and included home care workers in the minimum and overtime wage protections under the Fair Labor Standards Act (FLSA), as stated in the complaint. The suit claims the defendant was aware of the Final Rule and should have begun paying overtime wages to its home health aides in accordance with the FLSA, but failed to do so.
The plaintiff and other proposed class members provide home care to elderly and disabled clients.
