A proposed class and collection action filed in Kentucky alleges Hitachi America, Ltd. failed to pay manufacturing employees, specifically those with production supervisor titles, “who work between 60 and 70 hours per week” or more proper overtime wages. The plaintiff, citing alleged violations of Fair Labor Standards Act (FLSA) and Kentucky law, claims she and similarly situated employees were called “supervisors” and classified as exempt from overtime wages by Hitachi, yet their actual job duties indicated otherwise. In truth, the plaintiff alleges, she and other ostensible supervisors were not given managerial controls or authority to actually supervise other workers.
“Instead, they perform essentially the same work as other employees who do receive overtime pay, though they have leadership—not supervisory—responsibility for various manufacturing tasks,” the lawsuit asserts.
Further, the plaintiff, who the case says has worked for the defendant since 1999, alleges proposed class/collective members’—supposed supervisors—pay is based on time (hours) worked, not on a salaried scale. Therefore, the plaintiff and others similarly situated are entitled to time-and-a-half overtime wages, the lawsuit claims.
