A class action over alleged violations of the Fair Labor Standards Act (FLSA) has been filed against Health Care Solutions At Home, Inc. and its parent company Lincare.
A class action over alleged violations of the Fair Labor Standards Act (FLSA) has been filed against Health Care Solutions At Home, Inc. and its parent company Lincare Inc. Filed in Pennsylvania district court, the suit claims the defendants failed to pay the plaintiff, a driver who worked for the companies from 1984 through September 2016, proper time-and-a-half overtime wages. The plaintiff claims the defendants attempted to skirt paying overtime wages under an overtime-specific “motor carrier exemption” within the FLSA even though his work van weighed less than 10,000 pounds. Additionally, the plaintiff says class members automatically had wages deducted for lunch breaks even when they worked through lunch.
