A proposed class action citing the allegedly unlawful non-payment of minimum, overtime and spread-of-hours wages has been filed in New York against New Green Emporium Corp, which does business as the Green Emporium grocery store, and its owner. The defendants allegedly failed to pay the plaintiff, who currently works for Green Emporium as a restocker and cook, time-and-a-half overtime wages (owed for all hours worked over 40) for the 69 and 84 hours he works per week. Additionally, the plaintiff claims he is also owed spread-of-hours pay for shifts lasting longer than 10 hours in a workday.
