Allbright Construction, which operates as Green Day Construction, is facing a class action alleging the company violated the Fair Labor Standards Act (FLSA).
Allbright Construction, which operates as Green Day Construction, is facing a class action alleging the company violated the Fair Labor Standards Act (FLSA) and state wage laws. Filed in Illinois, the suit claims the plaintiff, a painter and general laborer who worked for the company from 2010/11 through September 2016, was not given proper overtime pay for hours worked over 40 in a week. In many cases, the plaintiff claims he was paid a flat rate for all hours worked, not the time-and-a-half rate of pay required by the FLSA for all hours worked over 40.
The proposed class covers all hourly employees who worked for Green Day Construction between October 28, 2013 and the present who worked more than 40 hours in any workweek.
