Two former employees have filed a proposed class action against Golden Corral Corporation claiming the buffet-style restaurant chain failed to pay proper overtime.
Two former employees have filed a proposed class action against Golden Corral Corporation claiming the buffet-style restaurant chain failed to pay employees in Kentucky proper overtime wages under the Fair Labor Standards Act (FLSA). According to the 25-page complaint, Golden Corral engaged in the practice of unlawfully misclassifying certain workers, in particular individuals working as “kitchen associate managers” and/or “hospitality managers,” as a means of avoiding paying overtime wages.
Both named plaintiffs say they worked between 50 and 70 hours each week—without being paid overtime—performing tasks that were “the same as or similar to” those of hourly, non-exempt employees. The lawsuit notes their duties did not include typical managerial tasks, such as hiring and firing workers, scheduling shifts or disciplining other employees.
