The owners of New York City fast food restaurant Global Kitchen, GKNY1 Inc., are facing a proposed class action filed by a former employee.
The owners of New York City fast food restaurant Global Kitchen, GKNY1 Inc., are facing a proposed class action filed by a former employee who claims he was not proper paid overtime, minimum or spread-of-hours wages. The plaintiff claims he was ostensibly hired by the defendants as a tipped delivery worker, yet was required to spend several hours each workday performing non-tipped, non-delivery-related tasks. The man alleges he (and proposed class members) were not paid time-and-a-half overtime wages, owed for all hours worked over 40 in a week, or spread-of-hours pay for shifts that lasted longer than 10 hours in a day.
According to the case, the defendants took a tip credit on the plaintiff’s wages to which they were not entitled, since the man’s non-tipped duties allegedly exceeded more than 20 percent of each workday.
