Gardens on the Bay Owners Association, Inc. and two individual owners are on the receiving end of a proposed class action lawsuit filed by an employee who claims he is not being paid proper overtime wages in accordance with the Fair Labor Standards Act (FLSA). The plaintiff, who has been employed by the defendants as a maintenance worker since 1997, alleges that he worked an average of 54 hours per week without receiving one-and-a-half times his hourly rate of pay for each hour he worked over 40 in a week. The suit claims the defendants were aware of the FLSA’s overtime requirements but “recklessly failed to investigate” whether their compensation policies complied with the law.
