Freedom Trailers, LLC and an individual defendant are facing a proposed class action seeking to recover allegedly unpaid overtime wages. Filed in Georgia, the lawsuit claims the plaintiff, who is currently employed by the defendants as a maintenance and production worker, regularly worked more than 40 hours per week without being paid at the time-and-a-half hourly overtime rate for his additional work time. Instead of compensating workers on an hourly basis, the lawsuit claims, the defendants paid workers based on their production, meaning the lump sum they received each week would sometimes fluctuate. At no point did the defendants take into account hours worked or overtime when calculating proposed class members’ pay, the lawsuit alleges.
